This is a Contest of BMW Canada Inc. Contest is open to attendees of BMW Invitational on October 6, 2024 at TPC Toronto at Osprey Valley in Caledon, Ontario (“Event”) who:
You are not eligible if you are: (a) an employee of BMW Canada Inc. (“Sponsor”), its divisions, affiliates, subsidiaries, parent or related companies, advertising or promotional agencies, or of the prize suppliers; or (b) a member of the immediate family (defined as parents, siblings, children and spouse, wherever they reside), or household of any of the above persons; or (c) are otherwise not eligible under these Official Rules.
No Purchase Necessary. Contest beings on Saturday, October 6, 2024 at 9:00am and ends at 3:00pm ET subject to weather conditions and hours of the event (the “Contest Period”).
The Contest will take place on the 14th hole of the North course at TPC Toronto at Osprey Valley located in Caledon, Ontario during the Contest Period (the “Qualifying Hole”).
Each eligible Event attendee will have one (1) opportunity to hit a golf ball and make a Hole-in-One subject to the terms and conditions set out in these Official Rules. A “Hole-in-One” is defined as shooting a regulation golf ball in one swing into the regulation golf hole at the required distance. The entrant’s tee shot on the Qualifying Hole must fall completely into the Qualifying Hole and remain there.
A Hole-in-One Prize (as defined below) will be awarded for the first “Hole-in-One” during the Contest Period. If no eligible entrant hits a “Hole-in-One” in accordance with these Official Rules, a “Hole-in-One” prize will not be awarded.
There is one (1) prize available to be won consisting of the following (“Prize”):
The Prize consists of a two (2) year lease of a 2025 BMW i4 xDrive40 with a Premium Enhanced
Package, M Sport Package and Standalone Options and up to 24,000 kilometres during the lease term, manufacturer’s warranty applies (“Vehicle”).
Approximate retail value: $48,739.52 CDN including freight, taxes, and pre-delivery inspection. Taxes, licensing and registration fees are extra and vary by province. Some Fees May Apply such as Federal A/C Excise Tax, Ontario Tire Stewardship Fee, PPSA Security Reg Fee.
Winner will be required to take possession of the Vehicle from the Canadian BMW retailer closest to the winner’s place of residence. Winner will be required to sign a lease agreement with the Canadian BMW retailer (the “Lease Agreement”). Winner will be responsible for any and all other expenses not specifically described above as included in the Prize including but not limited to adequate insurance coverage on the Prize pursuant to the terms of the Lease Agreement, licensing, registration, gas consumption, maintenance, excess wear and tear, excess mileage and/or additional accessories.. Once winner has been notified that the Vehicle is at the designated retailer, winner must take possession of the Vehicle within four (4) weeks or Prize may be forfeited, at the Sponsor’s sole discretion. Winner will be required to show proof of valid driver’s licence and valid insurance before being allowed to drive the Vehicle off the lot of the designated Retailer. The Vehicle must be accepted as awarded. The Sponsor reserves the right, at its sole and absolute discretion, to alter Vehicle specifications or substitute the Vehicle with a vehicle of equivalent or greater monetary value or of a different model year for any reason including but not limited to: delivery or production delays caused by labour disruptions, part shortages, or other unforeseen events, end of model year availability, and for any other reasons.

By participating in this Contest, entrants agree:

that the Sponsor and/or its authorized agents will collect, use, and disclose the personal information you provide for the purpose of administering this Contest and fulfilling prizes. With the entrant’s consent, Sponsor will also initiate, maintain and develop a relationship with the entrant (including product and service information, offers, etc.). Sponsor will collect, use and disclose this information in accordance with its Privacy Policy. to abide by the Official Rules and the decision of the Sponsor which are final and binding with respect to all aspects of the Contest.
Before being declared a winner, entrant must complete, sign and return any necessary forms, as required, by Sponsor or its agent by the deadline stipulated by the Sponsor including a Declaration of Compliance with the Contest Rules and a Liability and Publicity Release, releasing Sponsor, its divisions, affiliates, subsidiaries, parent and related companies, advertising and promotional agencies, and all of their respective directors, officers, shareholders, employees, agents, representatives, successors and assigns (collectively, “Releasees”) from any liability in connection with this Contest or the Prize(s). By accepting a Prize, winner agrees to Sponsor's use of his/her name, city/province of residence, picture, biographical information, statements, voice and likeness in any advertising and publicity Sponsor may conduct relating to the Contest in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice. Aggregate and/or anonymized Contest winner information may be used by the Sponsor to communicate about the Contest to its retailers and distributors.
BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT SPONSOR, ITS PARENT, RELATED AND AFFILIATED COMPANIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE "RELEASEES") HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, DEATH, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM A PRIZE, INCLUDING THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE. FURTHER BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT RELEASEES HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, DEATH, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) ENTRY OR PARTICIPATION IN THIS CONTEST, OR B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR MERCHANDISE DELIVERY. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you. Subject to obtaining approval from the Régie des alcools, des courses, et des jeux with respect to the Province of Quebec, Sponsor may terminate or amend this Contest at any time without prior notice, if any factor interferes with its conduct as contemplated by these Official Rules. Contest is subject to all applicable laws.
Entrants who have not complied with these Official Rules are subject to disqualification. All decisions of Sponsor are final and binding in all matters relating to this Contest. Sponsor may terminate or amend this Contest at any time without prior notice, if any factor interferes with its conduct as contemplated by these Official Rules, including but not limited to inclement weather. All play in the Contest is governed by the RCGA Rules of Golf, as amended by local rules and these Official Rules. In addition to the RCGA Rules of Golf, the Sponsor has established these Official Rules to govern the Contest. Contest is subject to all applicable laws.
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a decision. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
